“ Introduction: Who Is Responsible for AI-Generated Images

Neural networks have become tireless digital artists, but legal responsibility for their output rests with the human who enters the prompt and decides to publish the result. Even an image produced automatically can lead to a fine or a court summons. Anyone creating AI imagery in Russia must understand the legal boundaries that apply to its creation and distribution.

“ Trademarks, Brands, and Characters

Under Article 14.10 of the Code of Administrative Offenses, unauthorized use of a trademark is punishable by fines of 10,000 to 20,000 rubles for individuals and 100,000 to 200,000 rubles for legal entities. Under Article 180 of the Criminal Code, infringing exclusive rights to brands is a criminal offense. Generating images that closely resemble famous brands or characters from Disney, Smeshariki, comics, or video games is therefore risky, as is producing imagery that could mislead consumers about a product's origin.

“ Images Too Similar to Copyrighted Works

Article 1270 of the Civil Code protects not only original works but also their reproduction in any form. If an AI image reproduces the composition, angle, lighting, or colors of a known photograph or illustration to the point of confusion, it is treated as an unlicensed derivative copy. Under Article 1301, rights holders may claim lost profits and compensation ranging from 10,000 to 5,000,000 rubles, and in cases of deliberate copying, may demand the destruction of circulation and a public apology.

“ Religious Symbols and Imagery

Article 148 of the Criminal Code prohibits offending the feelings of believers. Publicly creating caricatures or parodies that mock religious shrines, sacred texts, rituals, or figures such as prophets, the Buddha, or Christ can bring up to one year of imprisonment, up to three years in aggravated cases, and fines of up to 500,000 rubles. Distribution online, in the media, or in places of worship increases liability. Federal Law No. 319-FZ of July 31, 2025 further requires that religious objects be depicted with their appropriate sacred symbols, such as crosses on churches, crescents on mosques, and Stars of David on synagogues.

“ War Memorials and Symbols of the Great Patriotic War

Article 243.4 of the Criminal Code penalizes desecration of military memorials with up to three years of imprisonment, extended to five years for monuments to the Great Patriotic War, along with fines of up to 5 million rubles. Creating images that distort symbols of military glory, parody memorials to defenders of the Fatherland, or present distorted historical facts falls under this prohibition. Article 354.1 separately criminalizes rehabilitation of Nazism, including glorifying Nazi criminals or downplaying the USSR's role in the victory.

“ State Symbols

Article 329 of the Criminal Code makes desecration of state symbols punishable by up to one year of imprisonment. Depicting the coat of arms or flag of the Russian Federation in a derogatory way, or taking any action that displays disrespect toward state symbols, is prohibited.

“ LGBT-Related Content and Extremist Symbolism

Article 6.21 of the Code of Administrative Offenses bans content that promotes non-traditional relationships, presents them as equivalent to traditional families, or portrays LGBT people positively, with fines of 50,000 to 100,000 rubles for individuals. Since the so-called LGBT movement was recognized as extremist in November 2023, Article 20.3 applies to rainbow flags in any variation, pink triangles, the lambda symbol, and any imagery associated with the movement, carrying fines of 1,000 to 2,000 rubles or up to 15 days of arrest.

“ Suicide, Drug, and Human Trafficking Themes

Articles 110.1 and 110.2 of the Criminal Code prohibit depicting, romanticizing, or providing information about suicide methods, or creating any content that could incite such acts, with up to three years of imprisonment when distributed online. Article 230 criminalizes depicting drug use, methods of producing substances, or promoting and romanticizing such a lifestyle, with three to five years of imprisonment, rising to fifteen years when internet use targets minors. Article 127.1 makes depicting coercion and exploitation of people, or creating recruitment material for human trafficking schemes, punishable by up to fifteen years of imprisonment.

“ Childfree Propaganda and Discrediting the Armed Forces

Since November 2024, Article 6.21 of the Code of Administrative Offenses has also prohibited content that promotes childlessness as attractive, claims its advantages, portrays motherhood in a distorted way, or criticizes the institutions of family and childbearing. Fines reach 400,000 rubles for individuals and 5 million rubles for legal entities. Articles 280.3 and 207.3 of the Criminal Code prohibit negative depictions of Russian servicemen, criticism of the special military operation, and content that discredits the Armed Forces, punishable by up to five years of imprisonment.

“ Extremism, Nazi Symbolism, and Child Exploitation

Articles 280, 282, and 20.3 categorically prohibit generating Nazi regalia and symbols, promoting national superiority, inciting religious hatred, creating symbols of extremist organizations, and calling for the violent overthrow of the constitutional order. Penalties range from administrative fines to up to twenty years of imprisonment. Articles 135 and 242.1 ban any sexual imagery of minors, with penalties from three to fifteen years of imprisonment. These are among the strictest prohibitions and apply regardless of artistic intent.

“ Practical Recommendations and Conclusion

Before generating images, study current legislation and avoid sensitive themes even in artistic interpretation. When in doubt, consult a lawyer, verify all content before publication, and keep documentation confirming its legality. Do not rely on artistic value as a defense, and do not assume a questionable image will go unnoticed. Russian legislation in this area is strict and continually tightening, with vague criteria that create additional risk. The guiding principle is that if there is any doubt, it is better to refrain from creating a questionable image than to risk criminal or administrative liability. Remember that the user who enters the prompt bears full responsibility for the result.
